Artificial Intelligence-Powered Chatbot Policy

1. The Digisac™ Platform may contain a customer service Chatbot and/or virtual assistant, whether native or customized, according to the contracted plan, for audio transcription, service summaries, copilot assistance (non-autonomous response assistant), text correction, and customer service agent. All functionalities are intended solely for customer service.

2. These functionalities are auxiliary to the Platform and, under no circumstances, shall be used as main functionalities. YOU may only use WhatsApp Business Solution Data to adjust an AI Model that is for exclusive use with such solution, and it is not permitted to develop other AI models with such data or within the Solution. YOU acknowledge that WhatsApp may terminate your account and revoke your access if it understands that YOU have violated these limitations.

3. Native or custom-developed Chatbots or Assistants, based on third-party Generative Artificial Intelligence technologies, such as OpenAI (ChatGPT), Meta (LLaMA), and other equivalent technologies, are subject to the policies and technical limitations of such providers. Ikatec™ does not guarantee uninterrupted availability or absence of failures when operation depends on APIs, cloud services, or third-party Platforms, such as OpenAI, Meta, messaging providers, hosting providers, etc. Instabilities, blocks, or policy changes by such providers shall not constitute breach of contract, as they represent an inherent risk of the technological environment.

4. Ikatec™ acts as a technology provider and service integrator and shall not be responsible for:

• availability or performance of third-party APIs, clouds, or Platforms;
• content, accuracy, or legality of responses generated by AI engines;
• automated decisions made by the CLIENT or its users.

5. Ikatec™ shall be liable only for the modules developed under its direct technical control. External failures, API blocks, or restrictions imposed by third parties shall not constitute breach of contract.

USE OF AI AND BEST PRACTICES.

6. YOU acknowledge that the use of channels such as WhatsApp Business (WABA) is subject to Meta Policies, current and future, including restrictions on the use of generative AI. The use of AI mechanisms on WhatsApp that violate such policies is prohibited.

7. AI responses and outputs are probabilistic and non-deterministic in nature and must be validated by human users before being used in sensitive contexts, such as legal, medical, financial, or decisionmaking contexts. YOU undertake not to use the Chatbot for unlawful, discriminatory, misleading purposes or purposes that violate third-party rights. Ikatec™ shall adopt reasonable technical quality and ethics measures, without guaranteeing the complete absence of biases or errors.

OPERATIONAL CONTINUITY AND TECHNICAL CHANGES.

In the event of failure, discontinuity, or policy changes by AI providers, Ikatec™ may replace the services with equivalent alternatives or adjust technical parameters without the need for a contractual amendment. If such changes imply additional costs, YOU will be 1 notified in advance. Blocks, data volume restrictions, periods of unavailability, or unilateral changes by providers are considered foreseeable risks by the contracting Parties and inherent to the technology.
